Do not assume that your local Fire and Rescue Service are always correct in their understanding and application of the Fire Safety Order 2005! Many do not even follow the Regulators Code or their own enforcement policies! Some have served notices on premises upon which the Order does not even apply to. These are just a few mishaps that we know of.
We also know from our experience that a number of solicitors do not know enough about the Regulatory Reform (Fire Safety) Order 2005 and assume that the Fire Service must be right in bringing charges. Consequently they advise their clients to enter an early guilty plea even when the wrong person may have been charged.
